stipulation for education for Asperger Child

Our grandson's mother would like to give up parental rights to our son. The mother is mentally ill. Our grandson has special needs - he was diagnosed as Asperger syndrome.

The mother has remarried. She did inherit a half million dollars from her grandmother. Can a stipulation be made in the termination proceedings, that some money be put in trust for this child?

The answer is yes. However, it is fairly complex. The law would say that no conditions or compensation go to the person giving up their rights. This would include what you have in mind. Yet, in the process of arranging the termination/adoption, something like this, if done in the right way at the right time, could possibly done as a benefit for the child. I say possibly because it is not possible for me to predict, without know the all the facts, how this will turn out. Also, the end result can vary in each case, in part what the judge believes is appropriate.
