Legal Question in Medical Leave in Wisconsin

FMLA- in regards to high-risk pregnancy and arrival of twins

Can the 12 weeks of FMLA be used non-consecutively? I was placed on bed rest for prevention of early delivery of my twins and for my own health benefits for the last trimester of my pregnancy. I was advised to apply for long-term disability as well, which will come into effect shortly before the babies are born (late February/early March) and end 6 weeks after. My district is telling me that FMLA & Disability are one in the same (as in 12 weeks total leave) and if I do not return to work at the end of March (the end of my 12 weeks), I will be considered as having ''quit'', and no longer receiving health insurance or other benefits. What are my rights? What can I expect?

The 12 weeks of FMLA do not have to be used consecutively. You may use the FMLA intermittently adding up to a total of 12 weeks. However, if you cannot return to work after the total of 12 weeks is used, you can be considered to have quit, i.e., the employer does not have to hold your job (or a comparable one) for you.
