Legal Question in Medical Leave in Wisconsin

Full time to part time

I was employed by a daycare center for seven years. I started my maternity leave at the end of May and planned on returning after labor day. After i returned to work the first day i was told that i was only needed for 4 hours a day. Before i went on maternity leave i was working full time. Is this legal for her to do to me?

Hello,

You cannot be penalized for taking leave, but your employer can decide that you are only needed part time. It is a matter of proving what the reason was... that can be hard to do.

I dont have all the facts, you should call an employment law lawyer in your area and request an opinion over the phone as to whether you have a case. Best Wishes, Mark J. Mahoney

Re: Full time to part time

There are a couple of answers I need to determine if you might have a case. 1. Did you take family medical leave for your maternity leave? 2. Exactly how many weeks were you off work? 3. Are there other employees working full time who are doing your prior job?
