Legal Question in Immigration Law in Wisconsin
I want to marry a Russian woman that is here on a tourist visa with children. Should we make application before it expires or does she have to go home and then return under fianc� visa?

My rule of thumb is don't leave if you don't have to. The primary reason is that if something goes wrong while physically present in the U.S., then you have access to appellate process where if something goes wrong while outside the U.S., access to appellate courts is extremely limited. That said, marriage soon after entry is an issue and how the case is filed, documented and presented at the marriage interview should be given due care.
