Legal Question in Immigration Law in Wisconsin
Im pregnant with an illegal immigrants baby and i need to file for child support, otherwise i will be cut off my public health insurance. Will he be deported since hes illegal?
1 Answer from Attorneys
State courts don't have jurisdiction over deportation of illegal immigrants. Only Immigration Judge can make a decision to remove (deport) him.
However, sometimes State court officials can inform ICE about a person's illegal status if it becomes known to them (they are not required to do so).
