You only have a case that you can successfully pursue if you can prove that either the surgeon or the hospital was negligent and that your infection resulted from that negligence. You would need an expert witness doctor to testify that either the surgeon or the hospital failed to do things the way they should have been done and that your infection resulted from that substandard care. Whether there is a case of negligence that could be proven depends upon the particular facts of your case. To determine whether, or not, there may be a case, you would have to find a lawyer willing to investigate your potential claim. An expert consultant would then have to review all of the records to determine whether your infection was a result of negligent care. There is a 3-year statute of limitations for medical malpractice cases in Wisconsin. That means that you have three years from the date of injury in which to file a case.
