Legal Question in Medical Malpractice in Wisconsin

Malpractice?

At about 13 weeks of pregnancy I was having some bleeding. At 15 weeks I decided to get it checked out and I was starting to cramp. I had an ultrasound done and they saw that my placenta was tearing away from the uterine wall which was the reason for the cramping and bleeding. I was sent home with no instructions as to what to do for pain or anything. My water broke two days after that. The baby was just fine but was to little to survive outside the womb. I have been told that some people have been hospitalized and or put on bedrest when they realized the placenta was tearing fom the uterine wall. I believe this could have saved my baby. Do I have the right to sue?

I have not handled a case like yours, but my sense is that your baby was still too young to be viable. You would need to hire a lawyer to determine whether there may be a claim, but I think the answer may well be negative. The statute of limitations for medical negligence cases in Wisconsin is three years from the date of injury, so that is the deadline in which you would have to file a case, assuming there is a case to pursue. Personally, I think the case is too tough to be one that I would want to become involved with, although someone else may be willing to look at it for you.
