My husband passed away on 9/23/05. Hopefully, you will be able to help me.

He had hepatitis B since birth. Around 10 years ago, because of high cholesterol, the doctor prescribed medication (Lipitor). A side effect to this medication is damage to the liver. Knowing about the Hepatitis B, I feel that the doctor should have kept closer watch on his liver function. At the very least, there should be 6 month blood tests done to keep track of this. That was never suggested by the doctor.

At March 2005, we had physical check up, I asked the doctor why my husband lost so much weight. His weight loss was noticeable at this time. The doctor's answer was because my husband ran and exercised. We believed him. We also had a blood test at that time. The laboratory test showed my husband's GoT and Gpt were not normal, so he was asked to re-check again. My husband did it a second time. We never heard back from the doctor or the lab. Because we didn't receive any phone calls, we thought everything was fine. In the middle of May, my husband started feeling uncomfortable. Around the beginning of the June, he went back to see the doctor again. The doctor ordered a CT scan for the coming Monday. On Friday night around 6:00pm, I received the

Your inquiry apparently exceeded the word limit, so I do not have all of the facts. I think you will have to contact a lawyer who does plaintiffs' medical malpractice work in your area to discuss the case in detail with the lawyer. The statute of limitations for medical malpractice cases is three years, so you must file a case within three years of the date of injury. Medical malpractice cases are generally tough cases to successfully pursue. To successfully pursue a case, you will have to clearly prove that the doctor was negligent and that the negligence caused your husband's death.
