Legal Question in Real Estate Law in Wisconsin

seller changed her mind

I am a friend of the seller who is an 80 yr old widow. She listed her house on a six month contract in Jan. '06. Two months ago she told her Realtor she changed her mind, wants to keep the house and rent it to someone. The Realtor said she couldn't do that without penalty of law. They made her feel she was doing something wrong and forced her to keep it listed with them. Shortly thereafter she has an offer. She rejected the offer and then asked again to take it off the market and the Realtor said ok. Two days later the Realtor tells her she is obligated by law to let the person submit another offer. She felt so intimidated by this she accepted the second offer. I feel she was forced into this against her will. Her true intent was to keep the house and rent it to someone. Even though she accepted an offer can she change her mind and not be forced to sell? Thank you in advance for your response.

Re: seller changed her mind

Hello,

Of course, I have only your side of the story, not the realtors. However, based on your facts, she should either be able to get out of the sale or have a remedy against the broker. You/she may be able to deal with this on your own, but I suggest you have an attorney first find out what all the facts are, and then help come up with some solutions. Let me know if you want me to help.

Best wishes, Mark J. Mahoney
