Legal Question in Wills and Trusts in Wisconsin
Probate
My Mother died October of 2004, without a will. Her Estate is still in probate. I am the Personal rep.
My Father died 14 years ago.
There were 6 children, but recently, my mentally ill brother, who was in a group home died.
The Lawyer that is handling my Mother's estate says that he will also need to go trhrough probate, even though he had nothing, but is due about 60,000 from My mother's estate. Had the Lawyer not taken so long with my Mom's estate, he would have had this money in a trust.
I'm not sure if I should have the same Lawyer handle both estates. Please, any advise would be appreciated.

Unless there were unusual issues, probates in Wisconsin are to be completed within 18 months. You should consider getting an attorney that can get these matters done for you in a timely basis. If you proceed with the one you are using, you should not have to pay extra for the additional probate work required to do your brother's estate, above what the trust administration should have cost. Seek competent counsel and get things done right!
