An heir has occupied her late fathers home since his death in August of 1999. There are a total of eight heirs with 33% to the executor and the remaining percentage divided amongst the other seven. The heir who currently living in the home would like to purchase the home and payoff remaining heirs but the executor has said he does not except the occupant heirs offer and is asking for more than what the home appraises for. Can the other seven heirs come together and agree to sell the home to the occupant heir for market value if their combined percentage is more then the executors percentage? It is also a fact that the heir who is currently occupying the property has maintained the home, payed property taxes, bills etc. which were legally the executors responsibility who knowingly let debts default.

no but the sale of the home must be approved by the court is this is a probate and at the hearing anyone can offer a higher bid and buy the house.
