can I sue a person that hit my car & totaled it out want to recover the inital investment

You can sue the person, but even if you win you will only be entitled to the value of your losses. That means the judgment will value the car at the time it was totaled, not the time when you bought it. If you paid $20,000 but the cars was only worth $8,000 at the time of the crash, you will only be awarded $8,000 for it.

You may also be entitled to other damages, especially if you or a family member were injured in the accident. I recommend meeting with some local personal-injury lawyers to discuss your situation.

I agreed with Attorney Hoffman, and would note that in Arizona you have a 2 year statute of limitations (time limit) within with to file your lawsuit if no settlement is reached.
