real estate commission 90 days late

My previos broker took more than 90 days to pay my commission. I made daily calls. He finally paid, but short paid by nearly $400. This is in California. Do I have any recourse for the time it took him to pay me? For the short, I know I have small claims as an option, but if I can claim additional damages for the collections process, it would be good to know how to do that.

Talk to the Labor Commissioner and the Department of Real Estate. The employer may be on the hook for penalties.
