Bigamy

11 months after i got married

my husbands wife served him with divorce papers. i moved out and haven't seen him since

that was is 1988. i have met someone and we want to get married. i would like to know if that marriage was legal since he was still married and would i need to get divorced first before i get married? i want everything legal this time. please let me know what i should do?

i don't know if it makes a difference or not but it was a confidential marriage certificate.

Although your marriage was probably not valid and is a nullity, you should file for a nullity to obtain a judgment declaring the void marriage. The risk is that you later find out that your marriage was valid and then your new marriage is not valid. Good Luck, Pat McCrary

You should apply for an annulment. You also might want to consider a prenup. The State of California has already written a prenup for you. I have yet to meet a single person who likes the pre-written pre-nup. But, unfortunately, I usually meet these people when they are getting divorced, when it is too late.
