Mom moved Child 1/2 way across country w/o Dad's knowledge

My boyfriend has joint custody of his son with his x wife. They were married in Cali., she left and moved to CO, got jurisdiction about 5 years ago, they got joint custody. Then she moved back to CA for 2 years. She said she was taking their son to Nappa for the weekend and packed up and moved back to CO, and wont give the dad any info. He wants his son back in CA, full custody or not. What are his rights?

An emergency motion can be filed in California, but the Colorado Court will have to be notified. The courts will have to decide jurisdiction. The longer you wait, the less likely it is you will get custody.

Depending upon the timing he can probably get sole legal custody of hi son. He should move quickly and he should get the advice of an attorney who does custody motions. Good Luck, Pat McCrary
