Legal Question in Landlord & Tenant Law in California

Our landlord sent an unlicensed technican to fix the heater in our rental house. The entire house caught on fire when he was fixing it. There is black soot and a terrible ordor in all of our belongings. To make matters worse there was abestos in the roof that caught fire. We did not have renters insurance. My husband was taken to the emergency room in an ambulance and spent 12 hours in the emergency room. Was my landlord negilgent for senting over an unqualified person? Because it was his fault will his insurance compansate us for our lost belongings and injury?

Your LL is responsible for hiring qualified workers, which could include licensed contractors. Whether or not the contractor was licensed, there may be a degree of negligence on both your LL and the contractor's part. You are entitled to full compensation for their negligence, and you are entitled to notification of asbestos, if the LL knew about it. You should consult a lawyer as soon as you can...Good luck..P

Structures normally do not catch on fire unless someone was negligent. The LL insurance should cover your damages, including to your clothing. While the man who trlied to do lthe repairs seems also to have some fault, you want to concentrate on the LL as he has insurance coverage. It should not be too difficult to find a local attorney who will take the case. You might want to see first what the insurance company is willing to do before you commit yourself to paying 1/3 of the amount that will may be paid.
