Legal Question in Wills and Trusts in California

Death of Step Mother

Step Mother has died and owns prime realestate left to her by her mother. She was married to my dad for 10 years, but lived together for 33yrs. Step children are not sharing with my Dad. Does he get part of the money from the sale of this property? They do have a probate Lawyer.

Re: Death of Step Mother

Since the assets came to step mother by inheritance, the assets may not be part of the marital estate. All of the documents related to this matter are important and need to be reviewed before a course of action can be recommended. Also, you mention both Oregon and California, but it is not clear in which state step mom abd dad are married and where they reside. If there is significant money at stake dad may want to hire a lawyer to look over all facts and documents to give him some direction. This is a fairly complex question.

Re: Death of Step Mother

If there is no will I would think dad should get 1/3 through the laws of intestate succession. Let me know if you would like to discuss your case with me. -John
