Re: Died without a will

If your father and stepmother owned the property (house, bonds, CD, etc.) in "joint tenancy" or as "community property", you are probably out of luck.... property held in joint tenancy goes to the surviving joint tenant. Property held as community property goes to the surviving spouse.

If you know the county where the home was owned, you can check with the County Recorder's Office or possibly the County Assessor to find out how title was held.

If the house was not held in joint tenancy or community property, then it will need to be probated. You are entitled to a copy of all of the documents filed in the probate proceeding.

Good luck.
