Legal Question in Workers Comp in California

Was injured at work approx 3 years ago have been on workers comp for 2 years case is getting ready to finish have had 2 surgeries (knee replacements in both knees) My attorney just called said he is quitting case, when it is almost over. Is he allowed to do this? Are their any ethics or other rule violations involved here?

Yes, the attorney can withdraw with court approval. At this point you should peititon the court for a waiver of attorney fees, since your attorney is not going to review the final settlement and proceed further. Alternatively, you can retain another attorney, forcing the attorneys to split your fees. The problem is a new attorney may not be willing to take the case if another attorney is getting part of the fee. And lower extremity cases typically do not rate very high under the AMA guidelines, meaning there are minimal attorney fees anyway.
