open w/c claim, claiment dies. Is family still entitled to settlement

I have an open worker comp claim with--name removed--co that has private w/c insurance. If I should die before the claim goes to court for--name removed--setttlement, and there is still an issue what % the injury is, would my family have the right to go to court to recieve the settlement, if I were dead?

Yes. The death of an injured employee does not affect the iability of the employer. In addition if the injury causes the death further benefits are awarded. Call me directly at (619) 222-3504.
