Legal Question in Workers Comp in California

would this be a workers comp issue

I injured my back two years ago at work and reported my injury to my employer. Worker's comp papers were filled out and I received medical treatment. I have had ongoing problems with back pain ever since and recently it's grown progressively worse. I asked my personnel manager to check into reopening my claim and was told that because it was over a year old they wouldn't reopen my claim.Do I have any options? I don't have the original paperwork from the initial injury. I have had to cover all medical expenes and am getting disability every two weeks at $200 less than what I was making at work. Is there a statute of limitations on worker's comp claims and if so what can I do? This is a work injury and I feel that my employer should be held responsible.

Whether you can re-open the claim depends upon the facts. You did not give enough information for me to evaluate your situation. Give me a call at 818-427-6246 (Cell) and I will have my workers compensation department take a look at it. I assume you were not represented by counsel on this. I must stress, you most always will get screwed unless you have an attorney representing you on a workers comp. case.
