Legal Question in Workers Comp in California

Workers Comp

My employer pays for a parking spot off-site (across the street) for me. I fell down the stairs in the parking garage on my way to work and hurt my knee and ankle. Does this qualify under workers' comp since my employer pays for the parking spot? What if I got hurt between the parking garage and my office building?

Another major question about your situation is when did your accident happen. If it was during your normal working hours, then you are covered under worker's compensation laws. Call us at 213.388.7070 for further discussion.

You will probably be successful in claiming benefits. However, I suspect you will have some difficulty given the circumstances. Therefore, I you will probably need an attorney.

Re: Workers Comp

Your are covered by W.C for this injury. Since your employer pays for you to park in that lot, it is deemed to be to his benefit that you do, so you are considered to have entered the employment premises once yo get out of your car, including if you should get injured crossing the street to go onto the physical premises of the business [as long as you are taking a relatively straight path to work; if made a detour to go to the neighboring Starbucks you probably would not be covered falling there]. You might also have a tort claim against the owner of the garage if something was left on the stairs causing you to fall.
