Refused to ''give'' blood test because of allergy to shrimp

I was arrested for dui. I elected to take a blood test. When I got to the station the paramedic asked me if i was allergic to shrimp i responded in the affirmative. They refused to draw my blood; the deputy then said it was a refusal to take the test; i asked repeatedly to be tested, they would not draw my blood. How can this be a refusal?

Not a refusal. You will likely need a lawyer to win this at DMV and Criminal.

Did they offer the breath test?
