Legal Question in DUI Law in Colorado

Seeking advice for friend arrested for dui

My friend was arrested for dui in Broomfield and was very cooperative, didn't even go to detox and was let out that next morning. She blew a .12 they couldn't find a vein for a blood test. She knows she messed up bad and is even going to AA. She wants to pay up for what she did. She knows she could lose her licence for 3 months and do community service. She really can't afford a lawyer along with the fines and insurance req's that will follow. Everything I have found says get a lawyer, but they are all lawyer sites. Will she fair alright expecting the worst? Any advice or reassurance would really put my mind and hers at ease. thank you for your time

It is best to get an attorney if at all possible. We get numerous calls from people who get worse than they deserve. Also, it helps to have someone to be there with you and explain what is going on. A lawyer may also help save the license or reduce the period of no driving. Many firms take payments.

I do DUIs in Broomfield and Boulder mostly. It seems like this is a first for her. The criminal aspect is likely not going to take much time or energy, but the DMV hearing is really important. It could save her license.

I suggest that your friend request a DMV hearing as soon as she is informed that her license could be suspended - breath is immediate, but blood usually takes a few weeks to get in the mail. The DMV hearing must be requested within 7 days of the notice of revocation. You just go to a DMV office and request it at the counter. On the form, it asks if you want the cop there - choose NO. This can be changed later if you choose NO, but not if Yes. This also allows your friend to keep her license at least until the DMV hearing.

I win DMV hearings fairly often. I would be willing to just do the DMV part for a retainer of $1000 and your friend will likely get 3-400 back.
