how to get my son back.

My son's mother and I had a verbal and written agreement to share custody of our son. She was suppose to bring him back to Colrado begining of November and never showed and now I can't get ahold of her. This is all because she was afraid she would see our son a x-mas. What to I do to get him back to colorado she is in South Dakota? Please help. I need him as much as he needs me

Child custody and parenting plans are transferrable between states. In other words, the court order granting you custody beginning in November is enforceable in South Dakota. You should file the Colorado custody decree with the district court in South Dakota, in the district in which the mother resides. Ask the South Dakota court to enforce the order. The court will grant an order, and you can take that to the sheriff or police in the county in which the mother resides, and they will assist you in getting your son. Please note that you should NOT try to do any of this without a court order and police assistance.
