Income Tax

I want to claim both of my children next year on my income tax return. There is nothing in the divorce papers about it. We have joint custody and I have physical custody. Can I legaly claim them?

You should consult with a CPA. New IRS regulations took effect as of January 2009 regarding claiming children of divorced parents as tax exemptions. Although the new regulations may or may not effect your personal situation, it's best to consult with a CPA to make sure.

If you have residential custody and the judgment doesn't provide otherwise, you get to take them.
