Help! Being sued, insurer dropped me

I'm a college student. A couple years ago, I rear-ended a man's car. I was not injured but he was taken to the hospital for whiplash. At the time, I was on my parents' insurance policy with Cheapskate Insurance Co. They probably have a considerable amount of coverage on that policy. A few weeks after the accident, Cheapskate dropped me but kept my parents. I got a new company right away, which I am still with.

Now this man is suing me, claiming he has had all kinds of pain and suffering because of me, etc. Should I go ahead and call Cheapskate? Are they liable, even though they are no longer my insurer? My parents still have their policy with them.

I assume you mean Chesapeake In. Co. Yes, you should notify them of any lawsuit against you while their policy was in force. The law also requires that you tell the opposing attorney the identity of your company and your coverage. I would hope that the policy covers you as a underage driver of your parents car.

Generally the attorney suing you will send a letter of representation asking you to forward it onto your insurance company. But either way you do want to inform them of the claim. They have a duty under the old policy to defend you in the action.
