Mother giving up custody

My husband and his ex wife currently have joint legal and physical custody of their 9 year old son. She is wanting to give us custody so she can move to Washington state because my husband won't agree to her taking him that far away from him. She said she would give us custody as long as we didn't come after her for child support which is fine with us we couldn't care less about the money we just want him away from her. Would it be legal for both of them to get together and write out on a piece of paper all the stipulations and agreements and have it notarized or would they have to go to court. Neither one of them have the money to go back to court but if we had to we would find a way to get the money. The thing is we don't want her to be able to come back and take him away from us if things don't work out in Washington. Any advice you can give me would be greatly appreciated. If you can't help maybe you can refer me to someone that can. We don't have the money to pay a consultation fee to ask someone a simple question.
