Legal Question in Personal Injury in Illinois

motorcycle accident

6 weeks ago i was backed into on my motorcycle, by a truck which is a major delivery company. The driver admitted fault and was ticketed. I had a broken bone in my foot. Today im going to the doc and will probably be released. Its feeling pretty good, but not totally back to normal. I rehab houses on the side, besides my full time job. We closed on a property 3 days ago. What bothers me is now I need to start woking on this property, I was unable to do various jobs I had planned to do on my own house, and rental house. Should I expect to be compensated for this in some way? My insurance company has told me they are admitting responsability.

Yes you are entitled to your medical, lost wages, pain and suffering and loss of normal life for the past, present and future.

It will be impossible to collect these funds without a lawyer and most likely a lawsuit.

Find an area lawyer who can show you previous jury verdict reports for this type of injury, and if you feel confident in his or her abilities, hire them to represent your claim.

You will have to pay around one third of the total but insurance company research suggests that unrepresented claimants are paid so much less than represented claimants that you can save money by having a solid lawyer.

But choose wisely because this relationship is long and based upon trust - just like a marriage!

Yes, you can seek compensation

for your losses. Because insurers

have become quite restrictive

in their payment of claims, you

can expect a low offer and a lot

of scrutiny on any income loss

Short answer is "yes." Legally, you are entitled to compensation of all your medical bills, pain & suffering and what we call "loss of normal life" which includes all the things that you used to do and now you cannot do at all or you can do them with difficulty.

You are also entitled to compensation of all your out of pocket expenses and any future medical expenses if those are necessary.

Without an attorney you will certainly be short changed. Neither the adjuster, nor the insurance company or anyone is on your side here. The fact that the insurance accepts fault, does not meant that they will automatically compensate you fairly. That only means that they know they have to pay you, but they will take apart your medical care, they will attack your pain and suffering telling you that you are exaggerating, lying or making things up etc... This is what they do. Insurance companies are NOT in the business of paying out on claims--despite what people may think. Insurance companies make their money by collecting premiums and then in not paying out on claims.

If you do not have an attorney working for you, you should get one. You have serious injuries and once you sign the Release, you are done--you only get one chance at this. So, you will want to have someone who knows all the tricks the adjusters will play on you and knows how to deflect them and is not afraid of taking the matter to trial if it comes to that.
