The disclosure stated, and we were told, that the basement had a 'small leak'. It is actually a 3'' flood. Do we have any recourse?

Possibly. It depends on whether the sellers were aware of the defect. We have had some pretty hefty downpours, so it is possible they were not aware. This is not legal advice, but make sure the gutters are clear, the grade slopes away from the house, and the sump pump, if there is one, is operating properly. There is a one year statute of limitation for bringing suit, so you should not delay in contacting an attorney.

I agree with the other attorney. However, A possible defense against you is that being told that there was a small leak, you were on notice of a problem and should have looked into it more fully.
