Legal Question in Traffic Law in Maryland

I Was going on a military Base With My Grandmother my license is suspended so i was not driving at the gate i was given a ticket for possessing a suspended license. I knew it was Suspended and am working on getting it straightened out. my question is what are the penaltys for possessing a suspended license and how does it work that i wasn't even driving?

In Federal Court, this type of charge carries a maximum of 6 months in jail. And there is no such thing as Probation Before Judgment for a traffic case in Federal Court. So, while it may not affect your ability to get a license at MVA, you may have it on your federal record the rest of your life. You should definitely consult a lawyer who may be able to find some ways you may not even think of to get the charge dismissed.

However, you may be charged under the assimilated statutes, which is sometimes how the federal government enforces violations of state motor vehicle statutes that occur on federal property. Your citation should indicate how you have been charged, and if it is under the assimilated statutes, then the judge is supposed to apply state law, which means that you may receive probation before judgement. I would have to see the citation.

In addition, I'd point out the basis for the citation may be speculative. I assume you were not driving and that your grandmother was driving through the gate. If you were not actively driving at the point of apprehension then the facts are questionable. Nonetheless the report of the guard is at issue.
