Legal Question in Civil Litigation in Massachusetts

Property damages by Neigbors children

Our new neighbors have erected and moble basketball hoop in their yard near our fence. They have repeatedly had the balls come over the fence causing damages to our garden, breaking plants and expensive pots. We are also concerned about the ball hitting my elderly Mother.

We have asked, on numerous occasions, to have them move the hoop into the driveway so there is no chance of this happening, but they refuse.

Do I have the right to keep any balls I find in my garden and what can be done to force them to move this hoop so all parties are happy?

Re: Property damages by Neigbors children

Yes, you can keep the balls.

You can sue them for nuisance and trespass.

One of the prayers can be that they move the hoop to the driveway.
