Legal Question in Personal Injury in Massachusetts

Right to get legal file from my attorney?

I retained a lawyer in a for an auto personal injury case on contingency--He never notified me of any insurance payments, correspondence or medical payouts. He will not give me copies of any correspondence and I am now getting dunning letters from the hospital and doctors that treated me. I would like to dismiss this attorney from handling the matter any further.

Am I entitled to the legal file containing all information pertaining to this case?

Re: Right to get legal file from my attorney?

In a word (perhaps oversimplified) yes.

It doesn't mean that it WILL happen, but it's good to know and to make the appropriate threat.

If you write to me directly, I'll look up and send to you the full text of the SJC rule which says what exactly a fired attorney must turn over to the client.
