Legal Question in Family Law in Michigan

estranged wife wants divorce

I reside in macomb county, I left my husband 11 years ago because of abuse and I have one son with him. I have had no contact with him in 11 years, can I get a divorce with out him finding me or having access to our son, whom he has never known? someone told me there is such a thing as a common law divorce and it is short and simple. Is this true?

Re: estranged wife wants divorce

There is no such thing as "common law divorce" in Michigan. You will need to commence legal proceedings to formally end your marriage. There is no way to do this covertly, although if you have an attorney you can minimize your contact with your ex-spouse. The trouble may be in finding your ex for service of process if you've lost track of him. For more info, please contact my office at (248)851-3171.

Have never heard of common law divorce. Michigan does not recognize "common law" marriages, so I doubt it recognizes common law divorce. If you were legally married, you need a legal divorce. You should hire an attorney who can give you reliable legal advice and do what is necessary and appropriate to protect your legal rights.

Good luck.
