In 2007 I put my kids on that property with me in case I should die. Now I am filing for divorce in 2011 . I have never seen my husbands pay check all the years we were married he has paid for nothing house payment utilities food taxes ins etc etc. He has a violent temper and is verbally abusive. If you had pre-marital property and kept it completely separate, you may be okay. However, if you comingled your assets in any way, such as having him make payments, pay for repairs, taxes, etc., you may have a problem. The fact that your kids' names are on the house, may be some evidence that you did not co-mingle the property but it is not determinative. You need a good lawyer.
