Legal Question in Civil Litigation in Michigan

Legal responsibility of family to inform

My grandaughter was recently a victim of a sexual predator. My daughter is thinking of filing a lawsuit against the family of the sex offender. She was wondering if they had a legal obligation to inform us of a previous situation(the accused was supposed to have previously been accused of doing the same thing to his own daughter).

Re: Legal responsibility of family to inform

I need more information before I can respond to your inquiry.

When did this occur?

How old was your grandaughter at the time?

How did your grandaughter come to be in this individual's company?

How old is the predator?

Was he then residing at hime with his family?

Was he prosecuted for his previous offense?

What was the nature of the harm to your grandaughter?

If you wish to discuss this at no charge, I can be reached at 248-680-1133.

Re: Legal responsibility of family to inform

Hello, I have received a copy of your e-mail regarding the assault on your granddaughter. You would have to show some type of "special relationship" between the family of the assailant and your granddaughter. This is normally difficult to do. There are several other legal theories that may be applicable but you have not provided sufficient information to determine if they would fit. Feel free to have her parents call to discuss the details further if they wish. John C. Talpos (248) 743-680 (http://www.Mich-Lawyer.com)
