Legal Question in Civil Litigation in Michigan

libel

my daughter is leader of a girl scout troop. another mother accused her of mishandling the troop's funds. a warrant was issued and my daughter had to meet the accountant for the girl scout council at her bank with her records for a surprise audit. the accountant cleared my daughter of any wrong doing. we know there will be rumors and her reputation will be damaged in the community. does she have any recourse? we are afraid this will hurt her chances of getting a job in the school system she has been going to school to get certified for for the last 5 years.

There are really not enough facts here to give you a good answer. Generally, when someone reports facts or even suspicions to the police and the police investigate, then there is no claim for libel -- despite the fact that the investigation may raise future suspicion. That is why people complain about the police labeling someone as a "person of suspicion" even when there is no probable cause.

If the person outright lies to the police, then that is a crime and an action could be pursued.

Really need more facts. Also, remember as well that bringing a claim could itself keep this in the public view and cause more people to learn about this than they otherwise would -- and if you failed to win a suit, it would strengthen suspicions. Be careful about what you wish for!
