Legal Question in Traffic Law in Michigan

auto accident

my daughter was in an auto accident, not seriously injured. she was making a left turn, judged she had plenty of time to make turn.the other driver was speeding(45mph-50mph)in a 35mph possibly 25mph school zone if flashers were on at the time. my daughteer went to hospital. neck ,back injury. she was ticketed for failure to yeild. witness say the other driver was speeding. how can i fight so that my daughter does not have anything on her driving record and possibly get insurance. we only carried plpd on her car.can we get her cleared and posibly into another car fom the other drivers insurance? does that make the other driver at fault?
