Legal Question in Family Law in Minnesota

I just heard my ex husband has been stalking me on Facebook and Driving past my house from a friend that actually heard this from him. I have an harassment restraining order in place, this is in violation. Do I need physical proof of this or can I call authorities.

What you have is "hearsay" and is not admissible as evidence in court to convict your ex for violation of the HRO. It is, however, a warning sign to you & it is time for you to take some precautions: 1st - Facebook - take a look at your privacy settings. Make sure your ex is blocked. Review your "friends" list & see how many are "friends" with your ex, then decide if you need to "unfriend" that person or ask them to also block your ex. I am no Facebook expert, so I would also ask Facebook how to track if your ex is monitoring your profile. 2nd - Local law enforcement - stop in your local police department & give them a copy of your HRO & let them know the information your have about him driving by your house. Give them a description of your ex & his car, where he works, etc. 3rd - Contact your attorney - sometimes a letter to your ex can help remind him that if he violates the HRO he can end up in jail.
