I recently was divorced, and my husband acquired the house. He failed to refinance right away to take my name off the mortgage, and is now in foreclosure. What are my rights pertaining to selling or taking over payments and keeping the house?

The answer depends on what remedies were included in the divorce decree. Your divorce decree must specifically spell out whether or not you have the ability t0o have the home placed on the market for sale if the other party fails to refinance or make payments. Without such language, you have no remedy. That is why it uis always important to have an experienced lawyer handle your divorce proceeding and draft important documents.
