Legal Question in Family Law in Mississippi

Pregnancy

My husband and I have been separated for 8 months. During our separation, I moved in with another man and have recently found out that I am pregnant. Can my husband use that against me in the divorce?

Re: Pregnancy

Yes, if he tries to make a case for adultery as basis for divorce. However, most people get a divorce on the basis of irreconcilable differences, and under the circumstances it would seem that he would have an objection to such a divorce. In such divorces, the only issues involve child custody and support, and division of property rights. In your case, you will not be able to get a divorce until after the child is born and the court will want to adjudge the parentage of your child so it can hold the father responsible for support.

Yes your spouse can use this against you. You are married eventhough you were seperated.
