Legal Question in Workers Comp in Missouri

work comp claim

If an employee gets hurt at a suppliers warehouse (on their property) wouldn't it be the responsibilty of that place to take care of that person instead of having to go through workmens comp since technically it happened there and not out on a job?

Re: work comp claim

What was the employee doing at the supplier's warehouse? I'll bet that the answer is "working". And who does the employee work for? I'll bet the answer is "the employer". Therefore the employer's worker's comp carrier will take care of the claim. By the way, it might be a good idea to consult with a worker's compensation attorney. Most will not charge to talk to you about your claim, and will take a contingency fee if it makes sense for you to hire the attorney to represent you on your claim. I know one of the very best worker's compensation attorneys in the state and I would be happy to refer you to him. Please feel free to call my office.

Re: work comp claim

There is insufficient information to answer this question fully, because it is unclear whether this is a loaned employee, etc. The simplified answer is that the location of the injury does not change the employer's workers' compensation responsibility. It may change jurisdiction for the claim. Also, other issues regarding premises liability would still need to be examined.
