Incomplete Step-Parent Adoption & Child Support

After my husband and I were married, he made the decision to adopt my daughter whose father was not involved in her life. Her biological father consented to the adoption and signed the paperwork termining his parental rights so that my husband could adopt my daughter. After the paperwork was completed, but before it was filed my husband changed his mind about the adoption after speaking to his mother who told him that if he adopted my daughter and we ever divorced, he would have to pay child support. Of couse he knew this already as he was advised as such by our attorney. In any case, the adoption was never completed. We've now been married almost 10 years and plan on divorcing. My daughter is 11. Is he legally responsible for her in any way? He says he wants visition rights, but doesn't want to pay child support. He is the only father she's ever known. What are her rights, if any?

The Court might consider this an equitable adoption and make him pay child support.
