Legal Question in Real Estate Law in New Jersey

My parents, who are elderly, rented a vacation home in Sea Isle City, NJ for the first week in August 2009. They signed a contract in September of 2008 and it was paid in full well before August 1, 2009. When they arrived at the rental property yesterday, a woman was there who claimed she had rented the property as well. Turns out, the owner uses four real estate agencies to advertise. The realty company my parents used claim they contacted the other agencies when they made the reservation, and that one of the agencies did not block the week off and rented it in February of this year, months after my parents. My parents were told that since the other people had gotten there first, there was nothing that could be done. Their agent than contacted a friend who owned a home and allowed my parents to go there. They paid for a five bedroom house and are now in a four bedroom house. The owner signed both contracts and claims she did not notice that there was a conflict. According to the realtor, the owner of the first house is going to transfer the money my parents paid to the owner of the second house. What, if anything, can be done? I am asking in terms of refund, etc. Thanks.

Your parents are entitled to a refund for the difference between what a five bedroom house and

what a four bedroom rent for.

File a small claims complaint. You can find the form online.
