Legal Question in Consumer Law in New York

I went on vacation in February and purchased a vacation club. I paid a down payment and signed up to have my credit card charged the 1st of every month for a year to pay off the balance. When I was never charged and began calling and emailing. I even called the corporate office and they had no documentation on me. I filed fraud with my credit card company. It has not been 7 months, and I am now receiving calls about this contract. Last week a person for the corporate office called and said that I would be allowed out of the contract. This week, I am receiving calls about past due amounts. I am worried about my credit. I don\'t know what to do since I bought this club in the Bahamas. Help?!

Legally I would have to read the language in the contract to offer advice. There is an obligation of payment, however, I do not know if payment by credit card is a material term to the contract.

Business advice - I would counsel you to accept there offer to release you from the agreement. If the vacation club cannot get its act together to receive payment, how many other problems are you going to have from this entity.
