Auto insurance where insured claims car was stolen

I was in an auto insurance in September where the other driver ran a red light and totalled my car. The owner of the other car claims the driver stole the car, and his insurance is refusing to pay the claim. But the police report that there was no credible evidence of theft, and did not swear out a warrant for the driver. How can I get the insurance company to pay up?
