Legal Question in Employment Law in New York

Nursing Home

I am a C.N.A (Certified nursing assistent) in a nursing home. I work 40 hours a week like everyone else. My adminestrator got fed up after months of C.N.A and nurses calling off that he decided to enforce the ''pink dot'' system. Every week your scheduled one pink dot which means if anyone calls off on the next shift ( i work 7-3 so for shift 3-11) or its scheduled short (less than 3 cna's). You have to stay a min. of 4 hrs. No if's, and's or but's. Today at work I witnessed a nurse being belittled and bitched at by the Director of Nursing because the nurse refused to stay saying she physically can not handle working 12 hrs. She was not scheduled to be pink dotted. Frankly, My fellow c.n.a's and nurses are tired of this treatment. We are all on the verge of breakdown and/quitting. We need help and advice.

Have you considered a union?
