Legal Question in Employment Law in New York

I was recently working new job through a temp agency. Best job ever. I was called in on Friday and told that the company, after my temp agency had already done this, ran another background check and I had something pending in the courts so I was in violation. I had some charges that were taken care of in March, or so I thought, they gave me an ACD which I was not told in the courtroom, and it doesn't drop off till Sept. 1st. It was imprudent speed resisting arrest and harassment. Is it possible now that I have all paper work showing dismissal on September 1st that I can get my job back?

The investigator or investigation company conducting the background check should provide you with the information so that you can take steps to remove this blight from your record.

Occasionally, an ACD -- in which the case is outstanding and technically still pending -- is not the best outcome.

Let me know if I can be of further assistance.
