Legal Question in Landlord & Tenant Law in New York

eviction notice

My boyfriend and I gave our landlord a written notice that we are moving out on 6/28/09 a few days ago and yesterday we got a 3 day to pay or get out letter from the apt manager. It said we had to pay back rent or get out and if not they will lock our doors and take our stuff. We have no place to go until 6/18/09 can they do this??

No. The landlord may not lock you out and take your items. The landlord must obtain a Judgment of Possession and Warrant of Eviction.

They have to take you to court. They will do so by summary proceeding and you will be in court next week. At the first hearing, show up with an attorney and see if you can work it out. Email me if you have any ?'S.
