Legal Question in Product Liability in New York

Taxi Cab Partitions

Where can I find information, such as case studies and statistics, on the dangers of partitions in taxi cabs? I was seriously injured when I was flung into the partition of a new york taxi cab. I broke my nose and several teeth. THis is a very common occurence. I would like to know whether more people are injured or protected by these devices. Please help. Thank you.

Re: Taxi Cab Partitions

In simplest terms, I do not know offhand where you could find those statistics. Nevertheless, I respond with a few thoughts, however. First, I believe (but again do not know with certainty) that the partitions in cabs is a requirement, which I believe is a city ordinance. Many times before legislation is passed, the legislative body, particularly the committee overseeing the piece of legislation, engaged in fact-finding. Thus, you might want to start with finding out whether such partitions are, in fact, required by ordinance or statute. If so, see whether you can obtain any documents from that legislative body regarding any fact-finding that the body (or committee) undertook before passing the law or regulation.

Second, if the partitions were legislatively required, I think a products liability case would be difficult to maintain.

Good luck.
